1.3 These terms and conditions govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code of the Czech Republic (hereinafter "the Czech Civil Code"), the mutual rights and obligations of the seller and of a buyer who is a consumer (hereinafter "the buyer" or "you") when a purchase contract is concluded through the online shop at www.exalted.com (hereinafter "the e-shop"). Through the e-shop the seller sells clothing and fashion accessories under the EXALTED brand.
1.4 These terms and conditions do not apply to buyers who purchase in the course of their business or independent professional activity. Relationships with such buyers are governed by the Czech Civil Code and by individual agreement with the seller.
1.5 Provisions that deviate from these terms and conditions may be agreed in the purchase contract. Such provisions take precedence over these terms and conditions.
1.6 The purchase contract can be concluded in the language of the language version of the e-shop that you use when placing the order. The purchase contract is governed by the terms and conditions in the language of that language version of the e-shop. In the storefront at https://exalted.com/eu the purchase contract is concluded in English. This version of the terms and conditions applies to purchases made through that storefront, which is intended for consumers habitually resident in Belgium, Bulgaria, Croatia, Cyprus, Estonia, Finland, Greece, Hungary, Ireland, Lithuania, Luxembourg, Malta, Portugal, Romania, Slovenia and Sweden, and also for consumers in Switzerland, the United Kingdom, Norway, Iceland, Liechtenstein, Monaco, Turkey, Serbia, Bosnia and Herzegovina, Montenegro, North Macedonia, Albania and Moldova; for deliveries outside the customs territory of the European Union, Article 6.3 applies. By placing an order in this storefront you agree that the contract is concluded, and the information relating to it is provided, in English. For contracts concluded through this storefront, this English version is the binding version of the terms and conditions; versions in other languages, including the Czech version, do not take precedence over it. Purchases made through another national storefront of the e-shop are governed by the version of the terms and conditions published in that storefront.
2. USER ACCOUNT
2.1 You can create a user account in the e-shop. You can also shop without registering.
2.2 You must provide true information in your account and keep it up to date. You must protect your login details against misuse.
2.3 We may cancel a user account if the buyer misuses it (for example repeated orders placed for improper purposes or misuse of discount codes). We will inform you of the cancellation by e-mail. Purchase contracts already concluded are not affected.
2.4 You can cancel your user account at any time at https://exalted.com/eu/delete-account or by a request sent to our e-mail address.
3. CONCLUSION OF THE PURCHASE CONTRACT
3.1 The presentation of goods in the e-shop is for information only and is not an offer to conclude a contract. Section 1732(2) of the Czech Civil Code does not apply.
3.2 You place the goods in the basket, fill in your contact and delivery details, choose the shipping and payment method and confirm that you have read these terms and conditions. Before sending the order you can check and correct all details. We treat the details stated in the order as correct. You are responsible for the consequences of incorrectly entered details, in particular the e-mail address and the delivery address.
3.3 You send the order by clicking the order button, which clearly indicates that the order involves an obligation to pay. By doing so you send a binding order that entails an obligation to pay the purchase price.
3.4 We will confirm receipt of the order to you by e-mail without undue delay. This confirmation is not an acceptance of the order. The purchase contract is concluded when we accept the order, at the latest when we dispatch the goods to you; we will confirm the conclusion of the contract to you by e-mail at the latest when the goods are dispatched. If we do not accept the order, we will inform you and refund everything you have paid without undue delay. Together with the confirmation of receipt of the order you will receive these terms and conditions in text form.
3.5 If the goods ordered are not in stock or cannot be delivered within the stated time, we will inform you by e-mail without undue delay after we find this out, and at the latest before the goods are dispatched. You may then cancel the order and we will refund everything you have paid without undue delay. If only part of the goods is unavailable, we will dispatch the available goods and refund the price paid for the goods not delivered within 14 days, unless you choose, within 3 working days of our notice, to cancel the whole order.
3.6 For unusual orders (for example a large quantity of goods or a high price) we may ask you for additional confirmation of the order (by e-mail or telephone). If you do not confirm the order within 3 working days, we will not accept it.
3.7 You bear your own costs of using means of distance communication (internet, telephone). These costs do not differ from the basic rate.
3.8 The purchase contract is archived by us in electronic form and is not publicly accessible.
3.9 The goods in the e-shop are intended for the personal use of buyers. We may limit the quantity of goods per order or per buyer. If we have reasonable grounds to suspect that an order is aimed at the resale of goods or at the misuse of a promotion, discount code, coupon or voucher, we may refuse the order or withdraw from the contract under Article 7.13.
3.10 You may ask us to change the delivery address or to cancel the order by e-mail to info@exalted.com. We will comply with the request if the parcel has not yet been handed over to the carrier and if our operations allow it. Once the parcel has been handed over to the carrier, you proceed under Article 6.5 or Article 7. No other changes to an order can be made once it has been sent; in particular, you cannot subsequently apply a discount code, coupon or voucher, add further goods or change the size or colour. Instead, you may ask us to cancel the order as described above and place a new order, or use the exchange under Article 7.15 after you receive the goods.
4. PRICE OF GOODS, DISCOUNTS AND DISCOUNT CODES
4.1 Prices of goods are final and include VAT and the other taxes and charges that we pay. The price does not include delivery costs, which are displayed before the order is sent according to the shipping and payment method chosen, nor, for deliveries under Article 6.3, customs duties, import taxes and charges. Prices are stated in the currency of the language and national version of the e-shop chosen (CZK, €, PLN, DKK, USD); prices in this storefront are stated in euro (€).
4.2 A price is valid for as long as it is displayed in the e-shop. We do not personalise prices on the basis of automated decision-making.
4.3 For discounted goods, we state the lowest price at which we offered and sold the goods during the 30 days before the discount was applied; where the goods have been on offer for a shorter period, we state the lowest price since we started offering them. Where a discount is increased progressively and the law of your country allows this, we state the lowest price during the 30 days before the discount was first applied. The percentage of the discount is calculated from this price.
4.4 Discount codes can be applied in the basket before the order is sent, subject to the conditions stated for the particular code (amount of the discount, period of validity, minimum order value). A discount code can also be applied to discounted goods. One discount code can be applied per order. In one order a discount code can be combined with one voucher, that is, with a coupon obtained in a promotion or with a gift voucher (Article 9), unless the conditions of the particular promotion provide otherwise. More than one discount code or more than one voucher cannot be applied in one order; this does not limit the rights of consumers habitually resident in Ireland under Article 9.2. The value of the voucher is deducted from the price first, and the discount under the discount code is then calculated from the remaining price.
4.5 A discount code, coupon or voucher cannot be exchanged for money. A code or coupon obtained in a promotion is governed by the conditions of that promotion.
4.6 Discount codes, coupons and vouchers cannot be used in parts. Each of them can be used only once, in a single order. If the price of the order is lower than the value of the coupon or voucher, the unused value lapses without compensation and is neither refunded nor paid out in money. This does not apply to the remaining balance of a gift card held by a consumer habitually resident in Ireland, where the law of Ireland requires otherwise (Article 9.2).
4.7 No discount code, coupon or other voucher can be applied to the purchase of a gift voucher.
4.8 If there is an error in the price or discount of the goods, in particular as a result of a technical error, a system error or incorrect data entry (for example a price or discount that is obviously grossly disproportionate to the usual price), we are not obliged to accept the order at that price. If the contract has already been concluded, we will contact you; you can decide whether to buy the goods at the correct price, otherwise we will withdraw from the contract and refund everything you have paid.
5. PAYMENT TERMS
5.1 You can pay online when sending the order, by payment card, Apple Pay, Google Pay, PayPal, Klarna (where Klarna is offered at checkout for your country of delivery) or other methods of the payment gateway. Payment by bank transfer and cash on delivery are not available in this storefront. The range of payment methods differs according to the country of delivery; the methods available for your country are displayed at checkout and are listed on the Payment methods page (https://exalted.com/eu/payments).
5.2 If you choose deferred payment or payment in instalments through an external provider (for example Klarna, where it is offered at checkout), you conclude a separate contract with that provider under its terms, which the provider makes available to you before the payment is completed. The provider may assess your creditworthiness. If you withdraw from the purchase contract or return the goods, we will inform the provider and the refunded amount will be taken into account in your obligation towards the provider.
5.3 The purchase price is payable when the order is sent. The obligation to pay is fulfilled when the payment gateway or the external provider under Article 5.2 confirms the payment to us. If the payment is not completed, is declined or is subsequently cancelled, we may refuse the order or withdraw from the contract (Article 7.13).
5.4 We dispatch the goods only after the purchase price has been paid in full (Article 5.3); Section 2119(1) of the Czech Civil Code does not apply.
5.5 We are a VAT payer. We will issue a tax document (invoice) and send it to you by e-mail at your request.
5.6 We treat any amount that you have received back through a payment dispute (chargeback) with your bank or payment provider as a refund under Article 7.8 or 7.14 and do not refund it a second time. We may cancel unused vouchers and coupons issued in connection with the order concerned.
6. SHIPPING AND DELIVERY OF GOODS
6.1 The countries to which we deliver, the carriers and the delivery times are stated on the Shipping information page (https://exalted.com/eu/delivery). Shipping prices are displayed at checkout before the order is sent. If we offer free shipping above a certain order value, the order value means the price of the ordered goods after deduction of the e-shop discounts and the discount from the discount code, excluding the shipping price. We may limit or cancel an offer of free shipping at any time; the shipping conditions displayed at checkout when the order is sent are decisive.
6.2 We usually dispatch orders within 24 hours of receiving them on working days. For popular drops and sales promotions with a large number of orders, dispatch may take a few working days longer; current information is available on the Shipping information page. The carrier's transit time is added to the dispatch time. In any event, we will deliver the goods no later than 30 days after you place the order. Your statutory rights in the event that the goods are not delivered are not affected.
6.3 For shipments to countries outside the European Union (for example the United Kingdom, Switzerland, Norway, the USA or Canada) and to territories of EU Member States that lie outside the EU customs or VAT territory (for example the Åland Islands or Mount Athos), customs duties, import VAT and other charges may arise. These charges are always paid by the buyer, usually on receipt of the parcel from the carrier. They are not part of the purchase price or of the shipping price.
6.4 You are obliged to take delivery of the goods. If the goods have to be delivered repeatedly or in a different way than ordered for reasons on your side, you bear the costs incurred.
6.5 If you do not take delivery of the parcel without having withdrawn from the contract beforehand, we are entitled to withdraw from the contract and will not send the parcel again. You shall reimburse us for the costs of sending and returning the parcel; we will set them off against the amount to be refunded. If you withdrew from the contract before taking delivery of the parcel, Article 7.8 applies and you bear the direct cost of returning the parcel.
6.6 On receipt of the parcel from the carrier you are obliged to check that the packaging is intact and to report any obvious damage to the carrier and to us without undue delay. If the damage to the packaging indicates unauthorised opening of the parcel, do not accept the parcel or draw up a damage report with the carrier. You shall report damage to the parcel or to the goods discovered only after delivery to us without undue delay, preferably within 2 working days, through the returns and complaints portal or by e-mail with photographs of the packaging, the shipping label and the goods; please keep the packaging until the matter has been settled. Your rights under the legal guarantee of conformity are not affected.
6.7 You acquire ownership of the goods when you take delivery of them, but not before the purchase price has been paid. The risk of damage to the goods passes to you when you take delivery of them.
6.8 If, at your special request, transport by a carrier that we do not offer in the e-shop is agreed, you bear the risk and any additional costs associated with that method of transport.
6.9 An order may be delivered in more than one parcel; you pay the delivery costs only once.
6.10 If part of the goods ordered is missing from the parcel or different goods have been delivered, you shall inform us without undue delay, preferably within 3 working days of delivery, through the returns and complaints portal or by e-mail with a photograph of the contents of the parcel. We will deliver the missing goods or refund their price; you return goods delivered in error using a shipping label that we provide to you free of charge.
7. WITHDRAWAL FROM THE CONTRACT, RETURN AND EXCHANGE OF GOODS
Time limit
7.1 You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. Where multiple goods ordered in one order are delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. Beyond the statutory right, we offer an extended return within 30 days under Article 7.14.
How to withdraw
7.2 To exercise the right of withdrawal, you must inform us (VEROC Brands Group a.s., Na Poříčí 1047/26, Nové Město, 110 00 Praha 1, Czech Republic; returns warehouse: Příšovice 287, 463 46 Příšovice, Czech Republic; e-mail info@exalted.com) of your decision to withdraw from this contract by an unequivocal statement. You can do so in particular:
a) online through the returns and complaints portal at https://exalted.com/eu/returns (the "Start a Return" link in the footer of the e-shop), where you enter your e-mail address and the order number and select the goods; a return request submitted in the portal within the withdrawal period under Article 7.1 is a withdrawal from the contract,
b) by e-mail to info@exalted.com,
c) by a letter sent to the address of our registered office or of our warehouse, or enclosed with the returned parcel.
You may use the model withdrawal form in Annex 1, but it is not obligatory. For fast processing we recommend that you state your order number.
7.3 We will send you an acknowledgement of receipt of the withdrawal on a durable medium (by e-mail) without undue delay, including its content and the date and time of its submission through the portal under Article 7.2 a) or, for a withdrawal made in another way, of its receipt by us.
7.4 Merely sending back or bringing in the goods without a statement of withdrawal under Article 7.2 is not an unequivocal statement of the decision to withdraw from the contract and we do not treat it as a withdrawal. We will inform you by e-mail that such goods have been delivered and ask you to tell us whether you are withdrawing from the contract.
Return of goods
7.5 You shall return the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us, by sending them to our warehouse at VEROC Brands Group a.s., Příšovice 287, 463 46 Příšovice, Czech Republic.
The deadline is met if you send back the goods before the period of 14 days has expired.
7.6 Costs of returning the goods:
a) returning the goods is free of charge if you use the shipping label or return code that the returns and complaints portal generates for you; the portal provides a label or code for the countries listed in Annex 2,
b) in all other cases (a country for which the portal provides neither a label nor a code, a different carrier, or a return without the label or code from the portal) you will have to bear the direct cost of returning the goods,
c) we may refuse to provide a free label or code to a buyer who abuses returns (Article 7.14 g)); you will then bear the direct cost of returning the goods. This does not affect your right to withdraw from the contract under Article 7.1.
7.7 We recommend that you return the goods with their tags and properly packed so that they are not damaged in transit. You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods (that is, handling beyond trying the goods on as you would in a shop), for example wearing, washing or traces of make-up or perfume. We determine the diminished value according to the established condition of the specific item, which we document with photographs, up to the purchase price that you paid for the goods. If the item has been worn, washed or otherwise damaged so that it can no longer be sold as new, the diminished value may amount to the full purchase price paid. You may dispute the amount of the diminished value. Where the diminished value equals the full purchase price, we will send the goods back to you at your request and at your expense. We will inform you of the amount of and the reason for the diminished value by e-mail with photographs of the goods. We will set off our claim for compensation for the diminished value against the amount to be refunded (Article 7.8).
Refund
7.8 If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. Evidence of having sent back the goods means a written confirmation from the carrier that it has taken over the parcel, which you send to us; merely creating a shipping label is not such evidence. If we establish a diminished value of the goods under Article 7.7, we will set off the compensation against the amount to be refunded. If it cannot be set off, you shall pay it within 14 days of our request. Until it is paid, we may refuse your further orders and refuse to provide you with the extended return under Article 7.14. If you withdraw from the contract in respect of all the goods in the order, we also reimburse the costs of delivery paid, up to the amount of the least expensive type of standard delivery offered by us. If you withdraw in respect of only part of the goods in the order, the costs of delivery are not reimbursed to the extent that they would also have been incurred for the goods that you keep. The costs of returning the goods are governed by Article 7.6.
7.9 We will carry out such reimbursement using the same means of payment as you used for the initial transaction. If this is not possible, we will send the money to the bank account that you specify. We will use another means of payment only if you have expressly agreed to it; in any event, you will not incur any fees as a result of such reimbursement.
7.10 If the goods were bought with a discount code or coupon, the amount that you actually paid is refunded. The discount from a discount code, coupon or voucher is allocated to the items in the order in proportion to their prices. A discount code or coupon that has been used is not renewed by returning the goods.
7.11 You cannot withdraw from a contract for the supply of sealed goods which are not suitable for return for hygiene reasons once you have unsealed them after delivery (Section 1837(g) of the Czech Civil Code, Article 16(e) of Directive 2011/83/EU). This concerns socks supplied in sealed hygienic packaging, which is marked on the goods. Goods in intact hygienic packaging can be returned in the usual way. You also cannot withdraw from a contract for the supply of goods made to your specifications or clearly personalised (Section 1837(d) of the Czech Civil Code, Article 16(c) of Directive 2011/83/EU).
7.12 If a gift is provided to you with the goods (for example goods free of charge in a 3+1 promotion), the gift contract is concluded subject to a resolutive condition: if you withdraw from the purchase contract and the goods that you keep from the order no longer meet the conditions under which the gift was provided, the gift contract ceases to exist and you must return the gift together with the goods. If the goods you keep still meet those conditions, you remain entitled to the gift. If you do not return the gift, the amount refunded is reduced by the value of the gift, that is, by its regular price in the e-shop without discounts at the time the contract was concluded.
7.13 We may withdraw from the contract before the goods are dispatched only for objective reasons, in particular if the goods are no longer manufactured or supplied, are not in stock and cannot be procured, in the event of an obvious error in the price (Article 4.8), if the purchase price is not paid (Article 5.3) or in the event of a reasonable suspicion under Article 3.9. Our right to withdraw from the contract under Article 6.5 is not affected. We will inform you by e-mail without undue delay and refund everything you have paid within 14 days by the same means by which the payment was received.
Extended return within 30 days
7.14
a) Beyond the statutory right of withdrawal under Article 7.1, we allow you to return goods purchased in the e-shop within 30 days of taking delivery of them. This is a voluntary benefit provided by the seller, not a statutory right of the buyer. A buyer who has not withdrawn from the contract within the statutory period under Article 7.1 can return goods from the 15th to the 30th day after delivery only under this Article.
b) The extended return can be used only through the returns and complaints portal at https://exalted.com/eu/returns. In the request you state the reason for the return and attach photographs of the goods being returned. We will confirm receipt of the request and provide a shipping label or code under the conditions of Article 7.6.
c) The goods must be unworn, unwashed, undamaged, with the original tags and in the original packaging. The original packaging means the bag or box in which the goods were delivered; the shipping packaging is not required. For goods in sealed hygienic packaging the packaging must be intact. We may refuse goods that do not meet these conditions; we will inform you of the refusal by e-mail with photographs and send the goods back to you at your expense.
d) You send the goods within 14 days of the confirmation of the request. We refund the purchase price of the goods within 14 days of their delivery and inspection, by the means set out in Article 7.9. If you return all the goods in the order, we also refund the delivery costs paid, up to the amount of the cheapest delivery method that we offer. If you return only part of the goods, the delivery costs are not refunded.
e) Articles 7.10 and 7.12 apply mutatis mutandis to goods bought with a discount code or coupon and to gifts.
f) After 30 days from delivery the goods can be returned only on the basis of your rights in respect of defects under Article 8.
g) We may refuse the extended return to a buyer who abuses this option, in particular one who repeatedly returns worn or damaged goods or repeatedly returns the major part of the goods ordered. The statutory right of withdrawal under Article 7.1 is not affected.
Exchange of goods
7.15 Within 30 days of taking delivery of the goods you may request an exchange for a different size or colour of the same product, through the returns and complaints portal at https://exalted.com/eu/returns. Goods can be exchanged only for a variant whose current price in the e-shop is not higher than the price at which the goods being exchanged were offered in the e-shop at the time of purchase (disregarding any discount code, coupon or voucher); any price difference is not refunded. Otherwise the goods can only be returned under Article 7.1 or 7.14. The exchange is a voluntary service provided by the seller and does not affect your right to withdraw from the contract under Article 7.1.
7.16 Goods can be exchanged if they are unworn, undamaged and with their tags. The exchange is possible subject to the availability of the size or colour requested. Goods cannot be exchanged for a different product; you can return them under Article 7.1 or 7.14 and order the other product separately. Each item can be exchanged only once. The periods under Articles 7.1 and 7.14 run from the delivery of the original parcel and are not extended by an exchange. We dispatch the new goods after the goods being exchanged have been delivered to us and inspected. If the variant requested is not available at that time, we will handle the request as a return of the goods (Article 7.8 or 7.14).
7.17 In some countries we bear the shipping costs of an exchange. The portal shows you, before you confirm the exchange request, whether the exchange is free of charge for you or how much you will pay. We may refuse an exchange to a buyer who abuses returns or exchanges (Article 7.14 g)), or provide it only against payment of the shipping costs.
Model instructions on withdrawal
(These instructions follow the model set out in Annex I(A) to Directive 2011/83/EU and apply to goods purchased in the e-shop. Further details are set out in Articles 7.1 to 7.17.)
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods; where multiple goods ordered in one order are delivered separately, from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (VEROC Brands Group a.s., Na Poříčí 1047/26, Nové Město, 110 00 Praha 1, Czech Republic; returns warehouse: Příšovice 287, 463 46 Příšovice, Czech Republic; telephone +420 731 883 333 (Czech and Slovak only; for other languages we recommend contacting us by e-mail); e-mail info@exalted.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form (Annex 1), but it is not obligatory.
You can also exercise your right of withdrawal online through our returns portal at https://exalted.com/eu/returns (the "Start a Return" link in the footer of our e-shop). If you use this option, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail), including its content and the date and time of its submission, without undue delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to us (VEROC Brands Group a.s., Příšovice 287, 463 46 Příšovice, Czech Republic) without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods. We will bear the cost of returning the goods if you use the shipping label or return code that our returns portal at https://exalted.com/eu/returns generates for you for the countries listed in Annex 2 (Article 7.6).
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
End of the model instructions on withdrawal
8. LEGAL GUARANTEE OF CONFORMITY (COMPLAINTS ABOUT DEFECTIVE GOODS)
8.1 We are liable for the goods being free from defects (in conformity with the contract) when you take delivery of them. You can assert a defect that becomes apparent within 24 months of delivery, or within a longer period where the law of your country so provides. At present the law provides for three years in Portugal and Sweden and sets no fixed period in Finland (where liability is assessed with regard to the expected lifespan of the goods) and in Ireland (where claims can be brought within the six-year limitation period); in Romania hidden defects that appear after the two years can be claimed within the average service life of the goods. Where the applicable law extends the period after a repair (for contracts concluded from 31 July 2026 in many countries once by 12 months) or lets it start again after a replacement, that rule applies. Please notify us of a defect without undue delay after you discover it. Where the law of your country requires a defect to be notified within a certain period after its discovery (at present two months in Belgium, Croatia, Cyprus, Estonia, Lithuania, Malta and Slovenia, and a reasonable period, of which two months is always sufficient, in Finland, Hungary and Sweden), a late notification has the consequences provided by that law. In addition, we provide a 36-month guarantee under the conditions of Article 8.10.
8.2 If a defect becomes apparent within one year of delivery, it is presumed that the goods were already defective when you took delivery of them, unless this is incompatible with the nature of the goods or of the defect. Where the law of your country provides for a longer presumption period, that longer period applies; at present it is two years in Belgium, Cyprus, Portugal and Sweden.
8.3 Wear and tear caused by normal use, damage caused by improper use, by failure to follow the care instructions (for example washing contrary to the label) or by mechanical damage is not regarded as a defect. Minor deviations in colour shade from the photographs in the e-shop that are due to the settings of the display device, and customary manufacturing tolerances in dimensions, are not defects either.
8.4 You make a complaint about goods bought in the e-shop:
a) through the portal https://exalted.com/eu/returns,
b) by e-mail to info@exalted.com.
State the order number, a description of the defect and the remedy you request; we recommend that you attach photographs. Send the goods complained about to the address of the warehouse (Article 1.2), unless you agree otherwise with us. The goods must be clean and hygienically safe; we may refuse to accept soiled goods for assessment. We do not accept parcels sent cash on delivery. We will provide you free of charge, through the portal, with a shipping label or code for sending the goods complained about once we have approved the complaint on the basis of the description and photographs. If you send the goods by another method although we have provided you with a free shipping label or code, the cost of that shipment is not considered reasonably incurred under Article 8.8 and is borne by you.
8.5 We will issue you with a confirmation of receipt of the complaint (the date, the content of the complaint, the remedy requested and a contact for information about its settlement). Where the law of your country requires further particulars (for example a record of the complaint in Hungary or a complaint register number in Bulgaria), the confirmation will contain them.
8.6 We will settle the complaint and inform you of the outcome within 30 days of the day on which it was made, unless we agree on a longer period with you where the law of your country allows this. Where the mandatory law of your country lays down shorter periods, those periods apply; at present:
a) Hungary: we will give you our position on the complaint within 8 days, unless we give it when the complaint is made,
b) Croatia and Estonia: we will reply to a complaint made in writing or by e-mail within 15 days of receiving it,
c) Lithuania: if we do not accept your claim, we will send you a reasoned written reply within 14 days,
d) Slovenia: if we dispute the defect, we will inform you in writing within 8 days; we will repair or replace the goods within 30 days of the notification of the defect, a period that we may extend by up to 15 days if we inform you of the extension and its reason before the 30 days expire,
e) Romania: we will repair or replace the goods within 15 calendar days of being informed of the defect,
f) Cyprus: we will repair or replace the goods within 25 days of the notification of the defect, unless you expressly agree to a longer period,
g) Bulgaria: we will repair or replace the goods within one month of the notification of the defect,
h) Portugal: we will repair or replace the goods within 30 days, unless a longer period is justified by the nature and complexity of the goods, the seriousness of the defect or the effort needed to complete the repair or replacement.
We will issue you with a confirmation of the date and manner of settlement, or with the reasons for rejecting the complaint.
8.7 You may choose between repair and replacement of the goods, unless the remedy chosen is impossible or disproportionately costly. You are entitled to a proportionate reduction of the price or may terminate the contract (withdraw from it) if:
a) we refuse to remove the defect or do not remove it in time,
b) the defect appears again,
c) the defect constitutes a material breach of the contract, or
d) it is clear that we will not remove the defect in time or without significant inconvenience for you.
You are not entitled to terminate the contract if the defect is only minor.
Before we remedy the defect, we will inform you of your right to choose between repair and replacement and, where the applicable law extends the period under Article 8.1 after a repair, of that extension.
If we do not settle the complaint within the period under Article 8.6, you may terminate the contract or request a proportionate reduction of the price. More favourable rights that the mandatory law of your country gives you, for example where a defect becomes apparent within 30 days of delivery, are not affected.
8.8 If the complaint is justified, we will reimburse you for the costs reasonably incurred (in particular the postage for sending the goods complained about).
8.9 Goods whose product description specifically describes a defect or shortcoming are sold at a lower price because of that defect or shortcoming; by placing the order you confirm that you have been informed of the defect and expressly accept it. The rights in respect of defects cannot be exercised for that specifically described defect. Other defects, including defects that become apparent later, can be complained about in the usual way. The right to withdraw from the contract within 14 days under Article 7 applies to these goods as well.
8.10 36-month guarantee. Beyond your statutory rights under the legal guarantee of conformity, we (VEROC Brands Group a.s., Na Poříčí 1047/26, Nové Město, 110 00 Praha 1, Czech Republic) provide a voluntary commercial guarantee of quality for goods purchased in the e-shop, for 36 months from the day on which you take delivery of the goods. You are entitled by law to remedies from the seller free of charge in the event of a lack of conformity of the goods, and those remedies are not affected by this commercial guarantee. In the first 24 months Articles 8.1 to 8.8 apply. From the 25th to the 36th month the guarantee covers only defects in material and workmanship (for example defects in seams, zips or prints) and is subject to these conditions:
a) the guarantee does not cover wear and tear caused by use, pilling, changes in colour, elasticity and other properties of the material caused by use and washing, damage under Article 8.3, goods that the buyer or a third party has altered or repaired, or goods under Article 8.9,
b) we will settle a justified claim, at our choice, by repair, by replacement with the same or similar goods, or by a voucher for a purchase in the e-shop, valid for 12 months, in the amount of the purchase price that you actually paid for the goods,
c) you claim under the guarantee in the manner set out in Article 8.4 and prove the purchase by the order number or by proof of purchase; the goods must be clean,
d) the guarantee benefits only the buyer who bought the goods in the e-shop and does not pass to other persons; a repair or replacement of the goods does not extend the guarantee period or cause it to start again.
During months 25 to 36, we bear the cost of sending the goods to us if we approve the claim in advance and provide you with a shipping label or code through the portal; if you send the goods without such approval or other than with the label or code from the portal, you bear the cost of sending them. We send repaired or replacement goods to you at our expense.
Where the law of your country gives you statutory rights for longer than 24 months (Article 8.1), your statutory rights apply in full for that whole period and conditions a) to d) do not limit them. To that extent this guarantee does not give you more than the law already does and is not an additional benefit.
9. GIFT VOUCHERS
9.1 A gift voucher (gift card, digital gift card) purchased in the e-shop is sent by e-mail and can be used only in the e-shop, as payment for EXALTED brand products.
9.2 A gift card has unlimited validity. A voucher provided other than by purchase (for example in a promotion) is valid for the period stated in the conditions under which it was provided; after that period the right under it lapses without compensation. A voucher can be used only once, in a single order. Any unused value lapses without compensation (Article 4.6). This paragraph applies only to consumers habitually resident in Ireland, because the law of Ireland requires it (section 66B of the Irish Consumer Protection Act 2007, inserted by the Consumer Protection (Gift Vouchers) Act 2019): where the price of the order is lower than the value of the gift card, a remaining balance of €1 or more does not lapse, and where you wish to use more than one gift card in one order, you may do so. In either case, please contact our customer support at info@exalted.com; we will activate the remaining balance for you as a new gift card with the same validity, or combine your gift cards into one gift card.
9.3 A voucher cannot be exchanged for money. You may withdraw from the purchase of a voucher that has not yet been used within 14 days of its delivery.
9.4 If you withdraw from a contract for goods paid for with a voucher, we will issue you a new voucher in the amount that you paid with the voucher for the returned goods, with the same period of validity as the original voucher, but for at least 3 months from the issue of the new voucher.
9.5 No discount code, coupon or other voucher can be applied to the purchase of a gift voucher (Article 4.7).

12. PERSONAL DATA PROTECTION
12.1 The processing of buyers' personal data is governed by the privacy policy available at https://exalted.com/eu/gdpr.
12.2 We may use the e-mail address and telephone number obtained in connection with your purchase to send you commercial communications about our own similar products and services, including requests to review the goods purchased, until you object, where and to the extent that the law of your country allows this without prior consent (the national provisions implementing Article 13(2) of Directive 2002/58/EC); otherwise we send such communications only with your consent. You can refuse commercial communications at any time and free of charge, in particular through the link in each message or by e-mail to info@exalted.com.
12.3 We may also process your personal data (in particular contact details and order data) for marketing purposes, in particular for direct marketing, for tailoring our offer and for targeting and measuring advertising, on the basis of our legitimate interest or, where the law requires it, your consent. You may object at any time to processing for direct marketing purposes; details are set out in the privacy policy (Article 12.1).
13. FINAL PROVISIONS
13.1 Legal relationships between the seller and the buyer are governed by Czech law, in particular the Czech Civil Code and Act No. 634/1992 Coll., on Consumer Protection. If you have your habitual residence in another country, this does not affect the rights that the mandatory provisions of the law of that country give you (Article 6 of Regulation (EC) No 593/2008, Rome I).
13.2 If any provision of these terms and conditions is invalid or ineffective, this does not affect the validity of the other provisions.
13.3 We may amend these terms and conditions. An amendment does not apply to purchase contracts concluded before the new wording takes effect.
13.4 We deliver documents relating to the purchase contract to the e-mail address stated in the order or in the user account, or to the postal address notified to us.
13.5 The content of the e-shop, in particular photographs, videos, texts, graphics, logos and the EXALTED trade marks, is protected by copyright and trade mark rights. It may not be copied, distributed or otherwise used without our prior written consent, in particular for offering goods to third parties.

3. How the e-shop meets the accessibility requirements
When creating and updating the e-shop, we follow the harmonised standard EN 301 549, which refers to the WCAG 2.1 guidelines at level AA for web content. The e-shop meets the accessibility requirements of Annex I to Directive (EU) 2019/882 in particular as follows:
a) perceivable: images and controls have a text description that screen readers can read; content can be enlarged using the zoom function of the browser or device; information is not conveyed by colour alone;
b) operable: the e-shop is designed to be operated by mouse, touch and keyboard;
c) understandable: texts are in the language of the chosen language version, which is marked for screen readers; form fields have labels; all details can be checked and corrected before the order is sent;
d) robust: the e-shop uses standard web technologies supported by common browsers and assistive technologies, for example screen readers;
e) identification and payment: logging in for payment and payment authentication take place with the payment service providers; Apple Pay and Google Pay allow you to pay using the accessibility features of your device;
f) information about the goods: the product page contains a text description of the goods, the material and size information.
4. Known limitations
Some parts of the e-shop may not yet fully meet all requirements. This concerns in particular third-party content and services (payment gateways, selection of a pick-up point on a map, embedded videos and social media content) and videos without subtitles. We continuously check and improve the accessibility of the e-shop.
5. Help and contact
If you encounter a barrier, you can write to info@exalted.com or call the telephone number stated in Article 1.2. We will help you complete your purchase and, on request, provide the information in this Annex orally or in another format.
6. Supervision
In the Czech Republic, compliance with the accessibility requirements is supervised by the Czech Trade Inspection Authority (Česká obchodní inspekce, https://coi.gov.cz); in the country of delivery, by the competent national market surveillance authority.
